Adeptica - Terms of Service

These Terms of Use ("Terms") govern your access to and use of the Adeptica service (the "Service"), provided by Adeptica UG (haftungsbeschränkt) ("Adeptica", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Service Overview

Adeptica offers an online platform where users can create decks and cards, upload images and files, and use artificial intelligence ("AI") to generate study materials. Adeptica also maintains a blog to share insights and trends within the space.

2. Definitions

User Content:

All content, including decks, cards, images, files, and any other materials uploaded or created by users.

AI-Generated Content:

Study materials, questions, or other outputs generated by processing user-uploaded files via AI.

Blog:

The informational content published solely by Adeptica staff.

3. Ownership and License

User Ownership:

Users retain full ownership of all User Content they create or upload.

License to Others:

By sharing their content publicly on the Service, users grant a non-exclusive, royalty-free license to all other users to use, reproduce, and share that content for free.

User Responsibility:

Users are solely responsible for the content they upload. Adeptica is not liable for any content posted by users.

4. Prohibited Content and Conduct

Users must not upload or share content that:

Contains political propaganda or content intended to influence public opinion;
Promotes terrorism, extremist violence, or hate speech;
Contains or disseminates child sexual abuse material (CSAM) or any material that exploits minors;
Contains NSFW (Not Safe For Work) or explicit sexual content inappropriate for a general audience;
Depicts or incites violence, criminal behavior, or other unlawful activities;
Violates copyright, trademark, or any other intellectual property rights;
Is defamatory, libelous, or otherwise in violation of applicable German laws.

Adeptica reserves the right to remove or disable access to any content that violates these rules, either upon detection or following a report by users. In cases involving illegal content, we may report the matter to the relevant authorities and provide all available user information (including IP address, email, and payment data).

5. AI-Generated Content and Accuracy Disclaimer

Processing:

Files uploaded by users are processed on external servers (e.g., OpenAI’s servers) where they are hierarchically broken down into topics and subtopics, and questions are generated accordingly.

Accuracy Disclaimer:

The accuracy of AI-generated content is not guaranteed.

Similarly, the accuracy of user-shared decks and study materials is not assured.

Intended Use: All materials provided by the Service, whether user-generated or AI-generated, are intended solely for study purposes. The Service enforces this usage via technical measures.

6. File and Image Upload Policy

Supported File Types and Size:

Images: Only webp, png, and jpeg formats are supported, with a maximum size of 10MB per file.

Files for AI generation: Supported file types are those accepted by the external processing server.

Processing: Uploaded images are converted to webp and scaled to an appropriate size on the server.

Uploading copyrighted material is prohibited.

Uploads that contain illegal content will be reported to the authorities with the available user details.

7. Blog

Content Management:

The blog is published solely by Adeptica staff. Users are not allowed to post comments or contribute directly.

Disclaimer:

The blog content is provided for informational purposes only. Adeptica makes no representations as to the accuracy or completeness of the content published on the blog.

8. Fees, Subscriptions, and Payment

General Use:

The Service is fundamentally free and ad-free.

AI Features Subscription:

Access to AI-driven features is available through a subscription model.

In connection with these features, certain user data may be shared with third parties (e.g., OpenAI, PayPal) as outlined in our Privacy Policy.

Data Use:

Apart from the AI features subscription, we do not sell or share user data with third parties.

9. Privacy

Your privacy is important to us. Please refer to our separate Privacy Policy for details on how we collect, use, and protect your personal information.

10. Dispute Resolution and Limitation of Liability

Governing Law:

These Terms and any disputes related to them are governed by the laws of Germany, specifically under the jurisdiction of Brandenburg.

Dispute Resolution:

Any disputes arising under or in connection with these Terms shall be resolved in accordance with German law.

Limited Liability:

Adeptica UG (haftungsbeschränkt) is subject to the limitations on liability provided by German law.

We do not warrant the accuracy, reliability, or completeness of any content provided by the Service.

Termination and Refunds:

Adeptica reserves the right to terminate user accounts that do not comply with these Terms.

In cases where termination occurs due to a breach (e.g., violation of upload rules), any fees paid for subscription-based features will not be refunded.

11. User Responsibilities and Conduct

Positive Interaction:

Users are expected to engage in friendly and positive behavior and to support one another.

Compliance:

All user behavior and content must comply with German law.

Prohibitions:

NSFW content is strictly prohibited.

Using the Service as an image sharing platform or referencing images hosted on our Service for external purposes is not permitted.

12. Modifications to the Terms

Changes:

Adeptica reserves the right to modify these Terms as needed.

Notification:

In the event of changes, users will be notified via a popup upon logging into the Service. Continued use of the Service after such notification constitutes acceptance of the updated Terms.

13. Termination

Adeptica reserves the right, at its sole discretion, to terminate or suspend any user’s account for violations of these Terms or for any conduct deemed harmful to the Service or its users. Termination may result in the loss of access to the Service and any associated data, and no refunds will be provided for any fees paid.
